Welcome to LTLprints.com! The following terms govern your use of, any purchases that you make from, LTLprints.com. YOUR AFFIRMATIVE ACTIONS OF USING OR MAKING PURCHASES FROM LTLPRINTS.COM SIGNIFIES THAT YOU AGREE ELECTRONICALLY TO THESE TERMS AND CONDITIONS. If you do not agree, do not use LTLprints.com.

You are responsible for maintaining at your own expense the equipment and Internet access that you will need to use LTLprints.com. LTLprints.com and it licensors own all copyright, intellectual property rights and database rights in LTLprints.com, its content, photographs and software. The content, photographs, database and software are protected by copyright and other intellectual property laws and treaties. We and our suppliers reserve all rights not specifically granted to you. You may not publish, distribute, extract, re-utilize reproduce, reverse engineer, decompile, or disassemble any such content in any material form (including photocopying or storing it in any medium by electronic means) other than in accordance with the limited use license we provide as follows. You may not modify, adapt, or create derivative works from LTLprints.com. Do not remove proprietary notices. Do not help any one else to do any of the things prohibited in this paragraph.

Use of LTLprints :
We offer you LTLprints.com (including its content, software and services) on a personal, limited and non-exclusive basis for personal and lawful use only. You may not transfer these rights to anyone else. If the service includes any download of software, you may download and install one copy of such software only on those computers that you directly own or lease. You may access the service only through the software, interfaces and protocols provided or authorized by us.

Your Use of Photographs : Stock Photographs
You agree that ordering a photograph from LTLprints.com obliges you to pay the relevant fee for that photograph. If you are purchasing any stock photographs offered on LTLprints.com (that is, photographs that you did not upload or provide), you may use the stock photograph that you order only for personal use. You may not make copies or such stock photographs and distribute or sell any copies of such stock photographs. All stock photographs displayed on LTLprints.com are protected by copyright. You are only given limited rights to use the stock photographs you purchase, as set out above, and you agree that you will only use the stock photographs for these permitted purposes (except where such use constitutes fair dealing under the Copyright Act 1994). Except for the limited rights to use stock photographs as set out in these conditions of use, you obtain no other rights in the Photographs you purchase.

Restrictions :
You may not submit, offer links from, share, post or transmit through the service any material, or otherwise engage in any conduct that:

• Violates or infringes the rights of others, including, without limitation, patent, trademark, trade secret, copyright, publicity or other proprietary rights.
• Offers for sale any content or products.
• Is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, obscene, pornographic, invasive of another's privacy, tortious, or contains explicit or graphic descriptions, or accounts of, sexual acts.
• Victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability.
• Impersonates any person, business or entity, including our employees and agents.
• Contains viruses, Trojan horses, works, time bombs or any other computer code, files or programs that interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment, or otherwise permit the unauthorized use of a computer or computer network.
• Encourages conduct that would constitute a criminal offense, or that gives rise to civil liability.
• Violates this Agreement, guidelines, the anti-spam terms below, or any policy posted on the service.
• Interferes with the use of LTLprints.com by others.
• Is completely commercial in nature, (i.e. ads)'
• Merely link to third party sites.

You must either own all right, title and interest in and to the copyrights in the images or have express permission from the copyright owner to copy and use such images for all purposes related to LTLprints.com, and the images may not violate or infringe upon the rights (including other intellectual property rights, privacy, moral or publicity rights) of others. Professional images that are provided to you by professional photographers or made available through websites, magazines, books or other resources, are protected by copyright and should not be uploaded, shared or copied using LTLprints.com. We may take any legal and technical remedies to prevent the violation of these terms.

No Spam :
You may not use LTLprints.com to transmit, directly or indirectly, any spam or other form of unsolicited bulk communications. You may not harvest information about our users for the purpose of sending, or to facilitate the sending, of unsolicited bulk communications. You may not induce or allow others to use LTLprints.com to violate the terms of this section. We may terminate your access or use of LTLprints.com immediately and take any other legal action if you, or anyone using your access to LTLprints.com, violates these provisions. We may take any technical remedies to prevent unsolicited bulk communications from entering, utilizing, or remaining within our network system.

We are not obligated for content provided by others
We are not liable for content or materials that are provided by others, including our advertisers. We are not responsible for content on the Internet. We have no duty to pre-screen content. We reserve the right to remove content from LTLprints.com for any reason, but we are not responsible for any failure or delay in removing such material.

Copyright Infringement :
If you believe that your work has been copied and is accessible on the service in a way that constitutes copyright infringement, please contact us by sending an email to copyright@ltlprints.com to report possible copyright infringement. In your email, you must provide us with the following information:

• Violates or infringes the rights of others, including, without limitation, patent, trademark, trade secret, copyright, publicity or other proprietary rights.
• The basis of the ownership interest of the intellectual property that you allege is being infringed.
• Where the material that you claim is infringing is located on the site so that we can locate it.
• Your full name, address, telephone number, and email address
• A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright or intellectual property owner, its agent, or the law.
• A statement by you, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.

International Use :
We make no representation that LTLprints.com is appropriate or available for use in locations outside the United States, and accessing LTLprints.com from territories where the service is illegal is prohibited.

Pricing and Product Information :
All prices are stated in U.S. dollars and are valid until altered by us. Prices do not include delivery charges or any import duties/taxes that may be added to non US destinations. Postage will be added to your order during the checkout process. Information about products is subject to change without notice. Prices are subject to change prior to our acceptance of your order. In the event that you order products and the price published on LTLprints.com was incorrect, we will contact you to let you know the correct price and ask you whether you still wish us to fulfill your order at the correct price. Any dates specified for delivery of any products are intended to be an estimate only. We reserve the right to reject orders that do not comply with any of our requirements. Order and shipping confirmation emails will be sent to our customers. You authorize us to charge you for purchases using the payment that you provide to use the service using the payment method you provide to us.

Returning a Damaged Order :
If your order arrived damaged, please contact our Customer Service service@ltlprints.com team online or call the toll-free number listed in your order confirmation email. We'll give you instructions for how to proceed with your return.

Disclaimer of Warranties :
We provide LTLprints.com "as-is," "with all faults" and "as available." We do not guarantee the accuracy or timeliness of LTLprints.com. WE GIVE NO EXPRESS WARRANTIES, GUARANTEES OR CONDITIONS. WE DISCLAIM ANY IMPLIED WARRANTIES, INCLUDING THOSE OF MERCHANTABILITY, ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, WORKMANLIKE EFFORT AND NON-INFRINGEMENT.

Limitation of Liability :
YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISPUTE WITH US OR YOUR USE OF LTLprints.com IS TO DISCONTINUE YOUR USE OF THE SERVICE.
WE, OUR OWNERS, EMPLOYEES, REPRESENTATIVES AND AGENTS, SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF, INABILITY TO USE, OR RELIANCE UPON SHARETHIS, EVEN IF WE KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL YOU BE ENTITLED TO DAMAGES THAT EXCEED THE TOTAL PURCHASE PRICE OF ANY PURCHASES THAT YOU'VE MADE WITHIN THE PRIOR TWELVE MONTHS OF THE DATE OF YOUR CLAIM.

If you don't love your print, contact us.

We strive to exceed your expectations with every print you receive. All Larger Than Life wall graphics are made with the best material available and a high quality digital printing technology. Most orders are produced and shipped within 24-48 hours.

If you are not satisfied for any reason, you may return your product for a replacement or refund within 365 days of receipt, subject to the following exceptions:

• International Shipments: Orders shipped to destinations outside North America (i.e. all destinations but USA and Canada) are final and cannot be returned for a refund.
• Custom Orders: Orders with custom images may only be returned due to damage in transit, in exchange for a replacement print.
• Canceled orders may be subject to a 5% refund processing fee.
• Shipping fees are not refundable.
• Return shipping fees are the responsibility of the customer if the reason for the return was due to no fault of ours.

To return your items:
You agree to defend, indemnify, and hold harmless us, our owners, employees, representatives and agents from all liabilities, claims, and expenses -- including attorney's fees -- that arise from your use or misuse of LTLprints.com.

General Terms:
These terms make up the entire agreement between you and us regarding your use of LTLprints.com. We may assign this contract, in whole or in part, at any time, with or without notice to you. You may not assign this contract, or any part of it, to any other person. You agree that the laws of Pennsylvania govern these terms and any claim or dispute that you may have against us. You further agree that any disputes or claims that you may have against us will be resolved by a court located in Philadelphia County, State of Pennsylvania, and you agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action. If for any reason a court finds that any provision or portion of these terms is unenforceable, the remainder of these terms will continue in force and effect. 11-23-2008
